Introduction

Welcome to Wallerson Allied Health. These Terms of Use set out the conditions under which you may access and use our website, www.wallerson.com.au (the “Website”). Please read them carefully before using the Website. By using the Website, you agree to comply with and be bound by these Terms of Use.

We have tried to keep these terms as plain as possible, though some legal language is unavoidable.

Wallerson Allied Health Pty Ltd (ACN 696 683 897) operates a multidisciplinary allied health consulting suite at C01, 37 Bosisto Street, Richmond VIC 3121, and offers room rentals, clinical supervision and practice mentoring to health practitioners. The Website is an information and enquiry platform. It is not used to deliver clinical or health services to clients, and no client bookings or client health information are taken through it.

Acceptance of these Terms

These Terms of Use are entered into between you and Wallerson Allied Health Pty Ltd (“Wallerson,” “we,” “our,” or “us”). They govern your access to and use of the Website, including any content, functionality and services offered on or through it.

By accessing or using the Website you:

  • accept and agree to be bound by these Terms of Use and our Privacy Policy, which is incorporated by reference;

  • represent that you are of legal age to form a binding contract with us; and

  • agree that if you access the Website from a jurisdiction where it is not permitted, you do so at your own risk.

If you do not agree to these Terms of Use, you must not access or use the Website.

Updates to these Terms

We may revise and update these Terms of Use from time to time at our discretion. Changes are effective immediately when posted and apply to all use of the Website thereafter. Continuing to use the Website after changes are posted means you accept them. We encourage you to review this page periodically.

Your Responsibilities

You must ensure that anyone who accesses the Website through your connection is aware of and complies with these Terms of Use. It is a condition of use that all information you provide on the Website is correct, current and complete. You are responsible for your own use of the Website and for your computer, internet and data security.

Prohibited Activities

You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to:

  • use the Website in any way that breaches any applicable Australian federal, state, local or international law or regulation;

  • use the Website to exploit or harm, or attempt to exploit or harm, minors in any way;

  • transmit or procure the sending of any advertising or promotional material without our prior written consent, including “junk mail,” “chain letters” or “spam”;

  • impersonate or attempt to impersonate Wallerson, a Wallerson staff member, another user, or any other person or entity;

  • engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or that may harm Wallerson or its users or expose them to liability;

  • use any robot, spider or other automatic device, process or means to access, monitor or copy any material on the Website without our consent;

  • introduce any viruses, trojans, worms, logic bombs or other malicious or technologically harmful material;

  • attempt to gain unauthorised access to, interfere with, damage or disrupt any part of the Website, the server on which it is stored, or any connected server, computer or database; or

  • attack the Website by means of a denial-of-service or distributed denial-of-service attack, or otherwise interfere with its proper working.

Intellectual Property Rights

The Website and its entire contents, features and functionality (including all text, images, logos, design, selection and arrangement) are owned by Wallerson, its licensors or other providers, and are protected by Australian and international copyright, trademark and other intellectual property laws. The Wallerson name, logo and branding may not be used without our prior written permission.

These Terms permit you to use the Website for your own personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download or transmit any material from the Website except that your browser may temporarily cache pages, and you may print or download one copy of a reasonable number of pages for your own personal, non-commercial reference.

You must not modify copies of any materials, or delete or alter any copyright, trademark or other proprietary notices. If you breach these Terms, your right to use the Website ends immediately and you must destroy any copies of materials you have made.

Room Rentals, Supervision and Mentoring Enquiries

The Website allows practitioners to enquire about renting rooms at our Richmond suite, and about clinical supervision and practice mentoring services we offer. Submitting an enquiry does not create any binding agreement, tenancy, licence or engagement. Any room licence, supervision arrangement or mentoring engagement is subject to a separate written agreement and is not formed through the Website.

Information on the Website about rooms, pricing, availability, supervision and mentoring is general in nature, may change without notice, and is provided to help you decide whether to enquire. Pricing shown excludes GST unless stated otherwise and is indicative only until confirmed in writing.

No Clinical or Professional Advice

The Website does not provide medical, psychological, health or other professional advice, and nothing on it should be relied on as such. Clinical supervision and practice mentoring offered by Wallerson are professional services provided to practitioners under separate agreement; general descriptions of these services on the Website are not advice and do not create a professional relationship. Practitioners who work from our suite operate their own independent practices and are solely responsible for the clinical services they provide to their own clients.

Third-Party Links and Content

The Website may contain links to third-party sites or content, including the websites of practitioners who work from our suite. We make no representations about, and accept no responsibility for, any third-party site or content. If you choose to access them you do so at your own risk and subject to their own terms and conditions.

Disclaimers

Your use of the Website and its content is at your own risk. The Website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, except those that cannot be excluded under applicable law (including the Australian Consumer Law). We do not warrant that the Website, its content, or the server that makes it available are accurate, reliable, error-free, uninterrupted, or free of viruses or other harmful components.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by law, and except for liability that cannot be excluded under the Australian Consumer Law, Wallerson and its directors, officers, employees, agents, contractors, licensors and suppliers will not be liable for any consequential, indirect, incidental, special or punitive damages, including loss of use, data, revenue, profit, business opportunity or goodwill, arising out of or in connection with your use of the Website, whether based in contract, tort (including negligence) or any other legal theory, even if advised of the possibility of such damages.

Where liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless Wallerson, its related entities and their respective directors, officers, employees, agents, contractors, licensors, suppliers and successors from and against any claims, liabilities, damages, losses, costs or expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms of Use or your use of the Website.

Privacy

Your provision of personal information through the Website is governed by our Privacy Policy, available at www.wallersonalliedhealth.com.au/privacy-policy. In summary, we collect personal information you submit through enquiry forms (such as your name, email and details about your practice) only to respond to your enquiry and manage our services. We retain personal information only as long as necessary for these purposes or as required by law, and we apply reasonable physical, electronic and procedural safeguards to protect it.

You have the right to access or correct the personal information we hold about you. Governing Law and Jurisdiction

These Terms of Use and your use of the Website are governed by the laws of Victoria, Australia, and applicable Commonwealth laws, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Website or these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia, and you submit to that jurisdiction.

Severability

If any provision of these Terms of Use is found to be unlawful or unenforceable, that provision will be modified to achieve as nearly as possible its intended effect, and the remaining provisions will continue in full force.

Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Wallerson in relation to your use of the Website and supersede all prior arrangements or understandings on that subject.

Waiver

No failure or delay by either party in exercising any right under these Terms operates as a waiver of that right, and no single or partial exercise of any right prevents any further exercise of it.

Notices

We may provide notice to you under these Terms by sending a message to the email address you provide, or by posting to the Website. Notices sent by email are effective when sent; notices posted to the Website are effective on posting. It is your responsibility to keep your email address current.
